LED companies trapped patents and industry standards

However, behind the rapid development of LED, it faces the dual constraints of standards and patents. Nowadays, as the gathering place of China's LED industry, Shenzhen has clearly felt the bottleneck, and enterprises are moving with challenges.

Patent-driven interest competition

According to some data, the upstream parts such as LED epitaxial wafers and chips account for about 70% of industrial profits. Due to the lack of core technologies in this area, this profit is almost monopolized by foreign giants. Many LED companies still rely on low cost and earn very little profit. The LED industry has almost become another new area of ​​“Made in China”.

In the core patent technology of LED, especially the key patents of white light, high-power LED lamp heat balance, long-lasting and efficient fluorescent powder, have been monopolized by European, American and Japanese manufacturers. Companies from the US, Japan and Europe not only occupy most of the market share, but also own 80%-90% of original invention patents in the upstream area of ​​the LED lighting industry chain.

Among the patent-related countries for LED applications, China only accounts for 9.34%, accounting for only 10% of global LED patents. An industry reality related to this is that more than 60% of China's LED companies are currently selling in overseas markets such as Europe and the United States.

It is understood that in the patent war, the number of Chinese LED companies that have encountered patent litigation has increased significantly. "Recently, two Shenzhen LED (light-emitting diode) companies have encountered patent litigation overseas, and finally ended up with compensation for settlement." Shi Shirong, executive vice president of Shenzhen LED Industry Association, recently worried about this. Shang Song, executive director of China Optical Optoelectronics Industry Association, believes that with the expansion of the market, the patent risks faced by Chinese LED companies will become higher and higher.

According to industry practitioners, in terms of industrial structure, although foreign manufacturers have core patents, they do not have production advantages. For the same LED application products, the foreign maturity cycle takes two years, and it takes only three months in China's industrial supporting environment. More than 70% of the world's LED application products are manufactured and manufactured in China. This is the main weight that China has in the "LED Patent War". "The industrialization of foreign manufacturers' core patents cannot even circumvent China's underlying technology."

In recent years, in order to prevent patent disputes between them, the giants who master the core patents have even suppressed newcomers and seized the international market. They frequently exchanged and authorized each other to arrange a rigorous patent network worldwide. It is understood that more than half of the core patents currently licensed by the core patents are authorized in China.

In order to deal with foreign monopoly, China's first LED patent technology industry alliance - Shenzhen LED Patent Alliance will soon be established. Qi Shirong pointed out that members of the LED Patent Alliance will set up a unified enterprise intellectual property management system to avoid independent development and redundant construction. A patent can be issued between the member companies of the alliance to form a patent pool.

In the patent battle with foreign LED manufacturers, the "patent pool" form will have stronger bargaining power. On the one hand, the authorized price of the core patent can be reduced; on the other hand, a core patent can be replaced by multiple application patents, thereby reducing the overall cost of the enterprise.

Standard missing bad currency

Some industry insiders said that the biggest dilemma of the LED industry is that there is no standard and no standard, so everyone is viciously competing, resulting in bad money driving out good money, which has a great impact on the healthy development of the industry.

As we all know, Japan and South Korea have successively issued a series of LED industry standards, but the progress of China's standards seems to be very slow. Yan Jun, deputy secretary-general of the National Semiconductor Lighting Engineering R&D and Industry Alliance, pointed out that the alliance hopes to strengthen cooperation with international manufacturers, and through the search for new ways of cooperation, develop a series of LED standards to play a leading role in further promoting the healthy development of the LED industry.

However, he also pointed out that at present, the LED industry is developing rapidly, and there are many kinds of LED lighting products, which cannot be finalized. Therefore, the formulation of standards requires a process.

At the same time, international monopoly manufacturers have seized the right to formulate LED standards. The turbulent LED standard battle has become the weight of the LED lighting market in various countries. It is hoped that the early release of LED lighting standards will grasp the right to speak in the global development of the domestic LED industry.

In February, in order to achieve the common development of lighting companies and industries, nine lighting industries including ABL (Acuity Brands), Cooper Lighting, Osram, Panasonic, Philips, Schrader, Toshiba, TRILUX and the Oudeburg Group The giant announced that it will launch an alliance of cooperative organizations within the industry to unify standards for various LED optical interfaces.

The pre-emptive action of the lighting giant provides a reflection for the industry: companies involved in the development of LED industry standards may greatly promote their business development.

Formulating national standards and participating in the development of international standards is the key to whether a country can win international competition. At present, China's lighting standard system is basically based on reference to international standards and European and American standards. The lack of corresponding independent research work provides technical support for standard formulation.

Experts have called for China to actively participate in the formulation of international standards for LED lighting. Although this requires a large amount of investment, it can strive to grasp more industry development initiatives through the formulation of international standards.

In fact, various ministries and local governments in the country are now formulating relevant standards for LEDs. The first local standard for LED street lamps in Jiangxi was approved. The local standard for road lighting LED lights in Shaanxi Province was also released. Shenzhen also released the first LED road lighting product standard.

However, these standards often share their own interests. The inconsistency of standards indulges local protection and creates a grey area, which also breeds many unfair competitions; and the more local standards, the more difficult it is to unify. This will lead companies to use the standard monopoly of local markets, but instead become an obstacle to industrial development. The state must further unify standards, standardize industrial development, and promote the formation of a fair and benign competition.

Especially at present, LED industry centers have settled in various places, and the capital market is also very active in the LED industry. Many industry researchers have indicated that the LED industry bubble has emerged. In order to promote the healthy development of the industry, it is necessary to focus on solving the patent disputes of enterprises, so that enterprises can easily go into battle and fully meet the challenges of the world lighting giants. In addition, it is necessary to award industry standards, standardize market competition, and create a fair and transparent development pattern.
